Judge Blocks Cops From Arresting Illegals?!

(Patriot.Buzz) – Although law enforcement’s utmost commitment should be to keep Americans safe from illegal aliens, a federal judge blocked a southern state rule giving police officers expanded power to arrest people who illegally cross the southern border.

An appointee of Ronald Reagan, U.S. District Judge David Ezra issued a preliminary injunction that blocked the Texas law criminalizing illegal border crossings.

This law, which categorizes illegal border crossing as a state crime, was challenged in court amid a surge in migrant crossings during the Biden administration.

Ezra said that this rule “may not exercise immigration enforcement power except as authorized by the federal government.” Likewise, Ezra added that the Texas law conflicts with the Constitution “to the detriment of the United States’ foreign relations and treaty obligations.”

This rule was proposed as Texas Senate Bill 4 and endorsed by Republican Governor Gregg Abbott, which gives law enforcement the ability to arrest and detain illegal immigrants and even grants state judges authority for deportation.

The Biden administration criticized the law by arguing that it interfered with federal immigration regulations.

Legal challenges swiftly followed, with the American Civil Liberties Union (ACLU) filing a lawsuit alleging discrimination and the U.S. Department of Justice subsequently suing the state. A Texas lawyer argued in court that the substantial flood of illegal aliens was equivalent to an invasion and quoted the constitutional rights under Article I, Section 10.

However, Ezra disagreed, stating, “I haven’t seen, and the state of Texas can’t point me to any type of military invasion in Texas. I don’t see evidence that Texas is at war.”

Governor Abbott, who vowed to uphold the law up to the Supreme Court emphasized its necessity due to Biden’s administration border policies. Despite the judge’s ruling, Abbott asserted the state’s commitment to the law and anticipated a resolution at the U.S. Supreme Court.

“Texas has the constitutional right to defend itself because of President Biden’s ongoing failure to fulfill his duty. We will not back down in our fight to protect Texas. This case will ultimately be decided by the U.S. Supreme Court,” Abbott wrote on X.
