(Patriot.Buzz) – Tired of playing to the tune of Democratic prosecutors, former President Donald Trump urged a Manhattan judge to throw out his conviction in a criminal case concerning hush money payments.
Trump’s legal team cited a recent Supreme Court decision that granted him absolute immunity for actions taken during his presidency.
This appeal was made through a formal request from Trump’s attorneys to Judge Juan Merchan, seeking to not only delay the upcoming July 11 sentencing but also to dismiss the case entirely.
The request followed a Supreme Court ruling that bars prosecutors from charging a president for any actions deemed official or using such acts as evidence in prosecutions, though it remains the responsibility of lower courts to define what an “official act” is.
This development in Trump’s legal saga comes just days before he is due to be sentenced for 34 felony counts related to falsifying business records to conceal an alleged affair during his 2016 campaign.
Trump’s lawyers argue that this new Supreme Court decision should influence the outcome of his May 30 conviction.
Set to respond to Trump’s legal maneuver, Manhattan District Attorney Alvin Bragg’s office has yet to make a public comment.
This case has drawn significant attention, with Trump claiming presidential immunity should have excluded certain evidence from his trial, specifically regarding his social media commentary about Michael Cohen, a crucial witness for the prosecution.
It is uncertain whether Judge Merchan will reconsider the conviction, especially since the deadline for filing post-trial motions has passed.
Trump celebrated the Supreme Court’s decision as a “BIG WIN FOR OUR CONSTITUTION AND DEMOCRACY” and expressed his satisfaction on social media.
In turn, a Biden campaign official critically described the ruling as effectively handing “the keys to a dictatorship” to Trump.
Joe Biden criticized the Supreme Court’s 6-3 decision for its potential to delay Trump’s federal case regarding the 2020 election.
Biden stressed the importance of resolving this matter legally before the next election, lamented that the Supreme Court’s decision makes timely justice “highly, highly unlikely” and deemed it a “terrible disservice to the people of this nation.”
