Court Stops Texas – Again?!

(Patriot.Buzz) – Underscoring that appellate courts have become Joe Biden’s personal tools to attack conservative policies, the ongoing legal confrontation between Texas and the Biden administration just intensified.

Specifically, a federal appellate court issued a temporary halt on Texas’ policy seeking to catch and deport immigrants suspected of illegally crossing the southern border.

The appellate court decision arrived mere hours after the Supreme Court’s authorized the statute’s temporary enforcement amid ongoing legal battles.

In a split 2-1 judgment, the 5th Circuit Court of Appeals issued a directive suspending Texas Senate Bill 4 while it waited for a thorough review of the case initiated by the Biden administration, as per Fox News.

Showcasing unity, the Supreme Court’s conservative justices denied the Biden administration’s plea to immediately suspend the Texas statute during the ongoing appeal in the 5th circuit, while the three liberal justices dissented.

The Supreme Court’s brief did not refer to the law’s legality but its temporary enforceability without explaining its rationale, which is typical of many emergency petitions.

Justice Amy Coney Barrett, with Justice Brett Kavanaugh’s concurrence, hinted at the possibility that the Supreme Court could eventually address the case’s substance.

“Before this Court intervenes on the emergency docket, the Fifth Circuit should be the first mover,” Barrett stated and emphasized that appellate court rulings have precedence over Supreme Court emergency interventions.

SB 4 authorizes Texas authorities to detain and imprison individuals suspected of entering the U.S. illegally and enables state judiciary directives for deportations. In turn, the Biden administration invoked the Constitution’s Supremacy Clause and criticized the Texas law as a violation on federal immigration jurisdiction.

Dissenting with the Supreme Court majority, Justice Sonia Sotomayor echoed the Biden administration’s concerns and predicted troublesome consequences from the law’s enactment. “The court gives a green light to a law that will upend the longstanding federal-state balance of power and sow chaos,” she said.

Meanwhile, supporters of SB 4, including Texas Governor Greg Abbott and Attorney General Ken Paxton, defended the state’s prerogative to safeguard its borders against perceived threats.

“[The] Constitution recognizes that Texas has the sovereign right to defend itself from violent transnational cartels that flood the State with fentanyl, weapons, and all manner of brutality,” Paxton remarked.
