(Patriot.Buzz) – In an attempt to solicit privileged treatment due to his family name, attorneys representing Hunter Biden, son of Joe Biden, have approached a federal court in Delaware seeking the dismissal of firearms charges against their client.

The attorneys argue that the indictment violates a previously established immunity agreement between Hunter Biden and the Justice Department. This request was detailed in a series of motions submitted to U.S. District Judge Maryellen Noreika by lawyers Abbe Lowell and Bartholomew Dalton.

The legal team is challenging the three counts related to firearms offenses, which include accusations of illegal possession of a gun while under the influence of drugs and making false statements on a federal gun purchase form.

The firearms charges, although distinct from the nine tax-related charges filed in California, are asserted by Hunter Biden’s attorneys to be encompassed under his collapsed plea deal that they claim still provides immunity.

In one of the motions, the lawyers stated, “The Indictment against Mr. Biden must be dismissed because it violates a Diversion Agreement that is in effect between Mr. Biden and the prosecution.” They elaborated that in return for relinquishing various rights, including his Fifth Amendment right to remain silent, the prosecution had agreed to grant him immunity for offenses related to his firearm purchase, among others.

This diversion agreement was integral to the original plea deal, which fell through in July under judicial scrutiny. Judge Noreika had raised concerns about the deal’s extensive scope, potentially shielding Hunter Biden from future charges unrelated to the tax and gun allegations.

Following the collapse of the plea agreement, Hunter Biden entered a not guilty plea to the charges. In the aftermath, his lawyer Lowell hinted at the possibility of filing a motion to dismiss the gun charges, maintaining the validity of the diversion agreement between the involved parties.

Furthermore, the defense team is challenging the federal prohibition on drug users owning firearms as a violation of the Second Amendment. This argument directly contradicts Joe Biden’s stance on the limits of the Second Amendment.

Hunter Biden’s lawyers also contend that the appointment of a special counsel to investigate him is unlawful and label the case as a politically motivated prosecution driven by former President Donald Trump and his Republican allies in Congress.
